Farmer Tom Lauerman LLC d/b/a FarmerTom.com is a Washington State LLC. We provide high quality products containing CBD (Cannabidiol derived from industrial hemp) that meet our personal expectations for use by ourselves and our family and friends, along with a Web Site, Auto Renewal Subscription service, educational and convenience based information and content, and Third-party content and services (collectively, “Services”) online. When you visit our Web Site to purchase products or otherwise engage in the Services, we are the controller of personal information we collect, and we will use or process it in accordance with this Privacy Policy. This Privacy Policy explains how and what information FarmerTom.com collects, shares, and uses in connection with the Services.

We may use single sign-on services that allow you to sign into this Web Site using social networking site (“SNS”) login credentials for accounts such as Facebook or Google. This allows you to link your existing social network profile to your FarmerTom.com Account. If you are not currently registered as a user of the Site, and you click on “Sign up” or “Log in” using an SNS that we support, you will first be asked to enter your SNS credentials and then be given the option to register for the Site. In this case, we may receive information from the SNS to make it easier for you to create an account on the Site and show our relevant content from your SNS friends you are allowing the Site to access your information and you are agreeing to the SNS’s Terms of Use in your use of the Site. Once connected, you may be able to post content on the social SNS website from this Site and interact with your friends from the SNS site(s). In general, we collect this information directly from you, or automatically from you, when you use Web Site or Services and/or to sell and deliver our Products to you.

Information collected when you use the Services or purchase products. We or our service providers may collect the following Personal Information about you such as Identifiers and Commercial Information (including payment card information, if you voluntarily provide it at time of check out) when you conduct business transactions with FarmerTom.com, including the purchase of products and Auto Renewal Subscription Service. We collect this information directly from you to sell and deliver products to you.

Information collected from our service providers. We may collect the following Personal Information about you such as Identifiers and Commercial Information when our service providers or other third parties (including our marketing partners or affiliates) lawfully share the Personal Information with us. In general, if we receive your Personal Information from our service providers or other third-parties, we process your Personal Information as a data processor on behalf of such service providers and third-parties. In that context, we only process the Personal Information as instructed by such third-parties, according to transparent responsibilities defined between FarmerTom.com and those third-parties, and in accordance with this Privacy Policy

Information not collected. We do not track or collect any sensitive information about you. This includes health, race, sexuality, religion, ethnicity, and/or political opinion.

You are not required to provide Personal Information to us. However, if you do not provide us with Personal Information, you may not be able to use certain features of the Web Site (including Account registration) or engage in online business transactions to purchase products. We may also collect Non-Personal or aggregated information in the form of marketing surveys, survey responses, demographic information, and information about your use of the Web Site and Services. Your participation in any surveys we conduct is voluntary.

We do not collect information that is considered sensitive under data protection laws, such as a social security number (or other government issued identification number) or health information (see HIPPA section below). If we receive sensitive information from you, we may delete it. We ask that you not disclose sensitive information to us or otherwise transmit sensitive information through the Web Site or Services, or through third-party services. Please notify FarmerTom.com at the contact information disclosed below, if you believe any of your sensitive information has been transmitted or disclosed to us and we will do our best to remove it.

PURPOSES FOR WHICH FARMERTOM.COM MAY USE YOUR INFORMATION

FarmerTom.com hopes to create an enjoyable experience for visitors. In order to create an efficient Web Site, we may process your Personal and Non-Personal Information for the following purposes:

  • Providing the Services: In order to provide the Services to you, FarmerTom.com may need to process your information to fulfill and deliver your orders, send an order and/or shipment confirmation, and to show you products that may be the best suited for your interests, along with your preference Information such as product wish lists, order history, marketing preferences, and reminder and notification preferences;
  • Operating and Improving the Site: We may use the information to customize the website according to your interests or for example to ensure the Web Site offers the correct products for your location. We may process some information to improve the Site and to ensure that it is operating as it should be. Some of this information we cannot delete as it may be part of our tax records for example.   • Communicating and contacting you: we may periodically send promotional emails about new products, special offers or other information which we think you may find interesting, or newsletter using the email address which you have provided. SOCIAL NETWORKING SITES

Some of our services may enable you to post content to social networking sites and other third-party platforms (“SNS”). USE AND SHARING OF INFORMATION

We reserve the right to use Non-Personal and/or aggregate information that does not identify, such as survey responses and other statistical information for any purpose. The Web Site’s main purpose is to provide a website for you to purchase and/or Subscribe to products. WE DO NOT SELL YOUR PERSONAL INFORMATION FOR COMPANY PROFIT TO THIRD PARTIES, AND WE DO NOT AUTHORIZE THE COLLECTION OF OUR ACCOUNT HOLDERS OR VISITORS PERSONALLY IDENTIFIABLE INFORMATION BY ANY THIRD PARTIES FOR THE THIRD PARTIES USE. When we disclose Personal Information for a business purpose, we enter into agreements with the recipients that requires the recipient to keep the information confidential. We may share your information with:

  • Third-Party Processors: your payment and transaction information is used to process your product purchase. Such information will be processed using a third-party processor. FarmerTom.com uses, Authorize.net and Zoho, as third-party service providers for payment services (e.g., card acceptance, merchant settlement, subscription and related services). By buying or selling on the Company Properties, you agree to be bound by the Privacy Policies of Authorize.net https://usa.visa.com/legal/privacy-policy.html and Zoho https://www.zoho.com/privacy.html and agree to allow FarmerTom.com to share any information and payment instructions you provide with these Third-Party Service Provider(s) to the minimum extent required to complete your transactions.
  • Service Providers: we may use various service providers to respond to customer inquiries, send emails, track engagement, fulfill and ship your order, or to otherwise provide you the Services. We may share your information with service providers to provide products and Services to you. FarmerTom.com uses ShipStation to fulfill and ship your order. You agree to be bound their Privacy Policy located at https://www.shipstation.com/privacy-policy/
  • Governmental Agencies: We may also share Personal Information if we believe in good faith that doing so is required by subpoena, court order, law, or is otherwise required to exercise or defend legal rights, take precautions against liability, protect the rights, property, or safety of any individual or Company Parties (defined in Terms of Use) protect the integrity of the Web Site and our products and Services, protect FarmerTom.com or others from fraudulent or unlawful activity, or defend FarmerTom.com against third party claims. In these scenarios, we will notify you of the disclosure, unless prohibited from doing so under applicable law, subpoena, or order.

In the event of a merger, reorganization, or other sale of some or all of FarmerTom.com assets, Personal Information may be considered one of the assets transferred to the new owner or acquiring party. In that context, we may share Personal Information with the new owner, potential owners, and the advisers related to the transaction or change of control of FarmerTom.com.

IN THE PRECEDING TWELVE (12) MONTHS, FARMERTOM.COM HAS NOT SOLD ANY PERSONAL INFORMATION FOR COMPANY PROFIT AND WILL NOT SELL YOUR PERSONAL INFORMATION FOR COMPANY PROFIT.

STORAGE OF PERSONAL INFORMATION

To support our products and Services, FarmerTom.com may collect, store, and process your Personal Information on our premises, data platforms, and private cloud storage solutions in the United States or with those affiliates and Third-Parties with whom we share your Personal Information as described in this Privacy Notice. The transfer or disclosure of your Personal Information to our U.S. systems or such Third-Parties, including in the United States, is necessary for the implementation of pre-contractual measures taken at your request when purchasing products, for fulfillment of product sales to you, and to enable FarmerTom.com and our service providers to give essential support to the Website, Services, and our products.

HIPAA

FarmerTom.com is not an entity that is covered by “The Health Insurance Portability and Accountability Act of 1996” (HIPAA). The HIPAA privacy rules apply to health plans, health care clearinghouses, to any health care provider who transmits health information in electronic form in connection with transactions for which the Secretary of Health and Human Services (HHS) has adopted standards under HIPAA (the “covered entities”) and their service providers (“business associates”). If necessary contact us with enough details and we will use our best efforts to remove it. WE DO NOT MONITOR, AND ARE NOT RESPONSIBLE, OR LIABLE IN ANY WAY FOR THE DISCLOSURE OF SENSITIVE HEALTH INFORMATION ABOUT ANY INDIVIDUAL ON ANY PUBLIC FORUM, OR THE TRANSMISSION OR USE OF SUCH INFORMATION BY THE GENERAL PUBLIC OR ANY THIRD-PARTY.

YOUR RIGHTS AND CHOICES (OPT-OUTS AND WITHDRAWAL OF CONSENT)

Do Not Track

There is currently no universally recognized standard for Do Not Track signals. Accordingly, at this time, cookies used on our Web Site and used in providing our Services do not respond to any Do Not Track signals or browser settings. When universally recognized standards are created we will adopt them.

Email Marketing Opt-Out

If you sign up for our newsletter or decide that you no longer wish to receive emails from us, you can opt-out or unsubscribe by clicking on the “Unsubscribe” link in the email you receive. Please allow up to ten (10) business days for us to process your unsubscribe request.

Data retention period

We retain Personal Information for a reasonable period to fulfill the purposes for which we collected it (as outlined in this Privacy Policy), including to defend our rights under product sales and other contractual Agreements with you.   • Right to Request Personal Information: Under the CCPA, California residents are given the right to receive information regarding the preceding twelve (12) months about the categories of personal information we collect and how it is used, the specific pieces of personal information collected, the categories of sources we share information to, and the business or commercial purpose for use of the information.   • Right to Request Deletion of Personal Information: The CCPA gives California consumers the right to request the deletion of any personal information collected and retained by FarmerTom.com, subject to certain exceptions such as tax records. Upon receiving your request, FarmerTom.com will verify that such request is accurate and complete and after also verifying your identity, will delete your personal information from its records, unless an exception applies.
  • Exercising Rights: In order to exercise your rights listed above, you must send a verifiable consumer request for deletion to info@farmertom.com. In your request, please include “CCPA Request” or similar language in the subject line so that FarmerTom.com can better and more efficiently aid you in your request. In order for your request to be a verifiable request, you must provide: (a) sufficient information, including your first and last name and email address, in order to identify you are the person or an authorized representative of the person in the deletion request; and (b) a description of your request in sufficient detail for us to understand and respond to your request. FarmerTom.com cannot respond to incomplete or unverifiable requests.

FarmerTom.com will make its best efforts to respond to a verifiable consumer request within forty-five (45) days of receiving the request. If FarmerTom.com needs more time to complete the request, it will confirm with you in writing. Disclosures will only cover the twelve (12) month period preceding your request.
